Conservation Easement Group Update

Sirote & Permutt attorneys Ronald A. Levitt and David M. Wooldridge will be featured presenters to the Charitable Planning Committee of the American College of Trust & Estate Counsel. The presentation will focus on planning and defending conservation easements and will include a discussion of key tax controversy matters regarding conservation easements and how tax practitioners should respond. The seminar will take place on June 26, 2011 in Atlanta.
The Conservation Easement group at Sirote has extensive experience in all areas of conservation easement planning and controversy. In 2009, the group litigated and won Kiva Dunes Conservation LLC v. Commissioner, a seminal case in the US Tax Court concerning conservation easements. The case was the first of its kind and set a great precedent for taxpayers.
Most recently, Levitt, Wooldridge, Gregory P. Rhodes & Nathan N. Vinson published an article in Taxation of Exempts entitled “Valuing Conservation Easements, Tax Court Analysis of Land Conservation Easement Values—Developments Since Kiva Dunes”. Taxation of Exempts provides tax analysis and guidance to members of the exempt organization community and practical understanding and guidance on tax-related developments.
Sirote’s Conservation Easement practice group is Ronald A. Levitt, David M. Wooldridge, Gregory P. Rhodes & Nathan N. Vinson. The group represents taxpayers who have been granted conservation easements in disputes with the Internal Revenue Service, including representation at all levels of the review and appeals process, and, if necessary, in Tax Court.
