Conservation Easement
The Conservation Easement group at Sirote has extensive experience in all areas of conservation easement planning and controversy. The practice group represents individuals and entities throughout all stages of the conservation easement process, including:
- Counseling on entity structure and transactions to maximize the value of the tax deductions attributable to a conservation easement contribution;
- Counseling throughout the contribution process, including advice regarding the multitude of state and federal statutory and regulatory hurdles to be addressed in the contribution process;
- Securing appraisal services and assuring that appraisals are performed in a manner consistent with the language and intent of the code and regulations so that the value attributed to a given conservation easement can withstand a possible challenge by the Internal Revenue Service or a State; and
- Representing taxpayers who have granted conservation easements in disputes with the Internal Revenue Service, including representation at all levels of the review and appeals process, and, if necessary, in Tax Court.
The conservation easement practice group has the knowledge and experience to identify and resolve potential issues related to conservation easements before they develop into costly and time consuming problems.
