The Sirote Employee Benefits group represents a broad spectrum of clients including public companies, closely held businesses, government pension plans and private professionals. Our attorneys in the employee benefits group regularly counsel and advise plan fiduciaries, investment advisers, and other service providers on ERISA and related matters and play an active role in the ERISA aspects of real estate and corporate transactions handled by the firm.
Our attorneys and paralegals in this group have extensive experience in the development and administration of qualified retirement plans, welfare and fringe benefit plans and executive compensation arrangements. We also have an abundance of experience in submitting tax-qualified plans to the Internal Revenue Service; correction of plan errors under both the Internal Revenue Service’s Employee Plans Compliance Resolution System and the Department of Labor’s Voluntary Fiduciary Correction Program; requesting private letter rulings from the Internal Revenue Service; advising clients (both employers and plans) on plan administration and interpretation; and advising clients on tax consequences of employee benefits plans.
The attorneys in our employee benefits group also team up with lawyers from our litigation group on a regular basis to bring and defend litigation involving employee benefit plans, ERISA, the Internal Revenue Code, and other federal and state laws affecting compensation and benefits. We have the capability to handle any type of suit, including disputes between participants and a plan or the plan sponsor, suits involving plan fiduciaries or service providers, and suits where the opposing party is the Internal Revenue Service, the Department of Labor or the Pension Benefit Guaranty Corporation.
