Litigation
Sirote & Permutt recognizes that often the greatest value litigation attorneys can provide to a client, especially a business client, is to assist them in recognizing areas of potential litigation and thereby avoid litigation. When litigation is necessary, to protect the client or to defend the client, Sirote & Permutt has developed a reputation for aggressive and effective litigation in state and federal courts throughout the Southeast. Our litigators continue to be at the forefront of change in modern business litigation and have met the challenge of rapidly escalating litigation costs by pioneering the effective use of technology and skilled paralegals in large, complex cases. In addition to representing clients in trial and appellate courts, our attorneys routinely represent clients in matters before administrative and regulatory agencies, and in arbitrations, mediations and other dispute resolution procedures. Our litigation clients include individuals and small business owners, as well as large public and private corporations. A significant number of the firm’s litigation clients are banks, mortgage companies and finance companies.
The firm’s trial department represents clients in virtually every type of litigation, including corporate, commercial, contracts, construction, products liability, securities, taxation, insurance, antitrust, intellectual property, personal injury, probate and domestic relations. Our firm has for many years concentrated in the defense of lender liability and consumer fraud lawsuits, including the defense of claims under the Truth in Lending Act, the Alabama Mini Code, the Fair Debt Collection Practices Act, and RICO. We are also proud to have litigators with particular experience in the areas of creditor’s rights, business torts, class action litigation, product liability litigation, ERISA litigation, Americans with Disabilities Act claims, bankruptcy and white-collar criminal defense. Our growing environmental litigation team represents clients in cases brought by regulatory agencies such as ADEM, EPA and the Department of Justice, as well as in cases brought by individuals for alleged violations of environmental statutes.
One unique aspect of Sirote & Permutt’s trial department is its ability to respond to situations which require immediate recourse to the courts. The firm recognizes that clients are often confronted with crises requiring immediate action, and it is experienced in both seeking and defending against requests for emergency injunctions.
