Matters routinely handled by Sirote & Permutt’s environmental practice group include permitting, administrative litigation, comments on proposed rulemaking, defense of state and federal enforcement actions, both civil and criminal, and cost allocation, cost recovery and reimbursement actions. A substantial part of the practice is in the defense of toxic tort claims and major mass tort litigation. Unlike other firms who have to staff such a claim with both a lawyer knowledgeable about environmental rules and a litigator, members of the environmental practice group bring a unique blend to toxic tort litigation, with each member having both vast experience in and knowledge of environmental rules, regulations and statutes, and expertise in litigation strategies and defenses to such claims. Often toxic tort litigation involves product liability issues, and the environmental practice group offers expertise in product liability litigation as well. The environmental practice group also has significant experience in pursuing insurance coverage for insureds seeking coverage for environmental costs.

The environmental practice group has significant experience in the areas of air, water, solid and hazardous wastes, toxic substances, chemical litigation, and cases under all federal environmental statutes, including the Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act, Toxic Substances Control Act, Safe Drinking Water Act, Surface Mining Control and Reclamation Act, the Endangered Species Act, the Comprehensive Environmental Response, Compensation and Liability Act, and the comparable state environmental statutes.
