Rushton is co-chairman of the firm's litigation department as well as a member of Sirote's executive committee. For more than 25 years Rushton has tried jury and bench trials in state and federal courts throughout the State of Alabama including obtaining a $20 million verdict representing plaintiffs in a class action breach of fiduciary duty case. He routinely prosecutes and defends claims for injunctive relief, including enforcement and defense of non-competition/non-solicitation agreements, as well as injunctions seeking to protect or defend against assertions of trade secrets. He was instrumental in changing Alabama’s law on anticipated nuisances. Rushton's practice also includes the defense of product liability and contractor liability claims, and the representation of insurance brokers, banks and other clients in business fraud, breach of fiduciary duty, shareholder derivative, directors and officer liability matters and other complex litigation claims.
