Sirote Success: Sirote wins summary judgment in class action

A federal court out of the Northern District of Alabama recently granted summary
judgment in favor of Sirote’s client in a class action lawsuit. The court found
that the assignment of mortgage recorded in probate court was not dispositive
evidence of when the note was transferred to the new lender. Therefore it did
not trigger the new creditor notification required by TILA, as the lender was
able to prove that it received the note much earlier by virtue of the PSA and
supporting securitization documents. Shaun Ramey was the lead attorney in
defending the lender in this class action suit.
